In its complaint, the regulator noted that the ETH sent to Balina was “validated by a network of nodes on the Ethereum blockchain, which are clustered more densely in the United States than in any other country.” The SEC then concludes: “As a result, those transactions took place in the United States.”

Good luck with that SEC. All nodes running within the United States fall under US Jurisdiction. Anything else simply doesn't. Want to test it Ethereum falls under US Jurisdiction. Ok if it does you should have no problems reversing a transaction or even just taking the network down. Go ahead and try either one of those. If you can't accomplish one or the other then claim it falls under US Jurisdiction all you want but if it really was within US Jurisdiction then either one of those tasks should be easy as cake. Now all those node operators certainly to fall within US Jurisdiction. So if you know who they are you can certainly take them offline. And then? And then Ethereum keeps running and there's not a thing any nation on this planet can do about it. These networks exist in no jurisdiction's. They're sovereign entities unto themselves.
